Everything Marlena Meneses claims to have known about the murder of Tim Bosma, came from the news. Not the boyfriend she was “with 24/7″, who is now on trial for first degree murder.
Meneses was 18 when she dated Mark Smich.
Nadir Sachak, lawyer for co-accused, Dellen Millard, pounced on Meneses: “Smich isn’t telling you anything? It’s all coming on the news?”
“Yup”, she responded.
Meneses says Smich was horrific and controlling. She says Smich would hit her. Having left home to be with him, Meneses says she had nowhere else to go.
She broke into tears on the stand.
Meneses says Smich wanted her to be a stripper so he didn’t have to work.
She says he wanted her to get a job so Smich could “spend his days playing videogames and writing violent rap lyrics about others girls”.
Meneses told the court that Smich forced her to sell weed for him. He would use tricky scales and then have Meneses face buyers, knowing they were being ripped off
Meneses became frustrated on the stand, after being pressed by Sachak on why she couldn’t remember what she told police on the day of Smich’s arrest.
“You had no doubt that [Smich] buried a gun,” Sachak pressed. “That it had been used to shoot Tim Bosma. That Smich had taped it up, dug a hole, and buried the evidence.”
“Yup”, said Meneses, again.
When pushed even further by Sachak, she agreed that she knew as early as May 8, 2013 that Smich and Millard were together on the night Bosma was killed.
Meneses also admitted to lying several times on May 22, 2013, when meeting with police about “The Eliminator”.
“You lied under oath”, stated Sachak. “You lied after being warned numerous times”.
“Yes”, Meneses acknowledged.
She just couldn’t explain why.
Millard, 30, and Mark Smich, 28, are on trial for the first-degree murder of Tim Bosma, the Ancaster dad who disappeared May 6, 2013 after taking two men for a test drive in his pickup truck.
The Crown believes Bosma was shot point-blank in the truck and then incinerated.
