“Never trust a drug addict” — the quote from TV show Breaking Bad that Dellen Millard wrote to then-girlfriend Christina Noudga.
With Noudga on the stand for cross-examination at the Tim Bosma murder trial, Millard’s lawyer asks who he was referring to in the letter.
“Mark Smich”, responds Noudga.
Millard, 30, and Mark Smich, 28, are on trial for the first-degree murder of Tim Bosma, the Ancaster dad who disappeared May 6, 2013 after taking two men for a test drive in his pickup truck.
The Crown believes Bosma was shot point-blank in the truck and then incinerated.
Noudga was asked about a four-minute phone call she had with Smich on May 10, 2013.
“Shit went down”, Noudga says Smich told her. “I screwed up. Don’t worry. [Dellen Millard] is fine.”
“What do you mean, Mark? What did you do?” Noudga responded.
Noudga testified that Smich sounded as though he was blaming himself.
“My assumption based on his reaction was that [Millard] was helping Smich out,” Noudga testified. “That was [Millard’s] personality. He didn’t choose his loyalties very carefully.”
Justice shut down the questioning, saying assumptions are not evidence.
Smich’s lawyer charged across the court room in reference to Millard, “you are still in love with him!”
“You can suggest that,” Noudga responded. “But I have no feelings for him.”
“…and when did that stop?”
Noudga answered, “when he got me arrested”.
She was arrested 11 months after Dellen Millard; charged with accessory after the fact to murder.
“I progressively started falling out of love with him when I spent four months in a tiny box,” Noudga continued. “I started feeling contempt and loathing.”
Christina Noudga was then starting to hear rumours about Millard cheating on her. She says she was humiliated.
“He put me in a situation that I shouldn’t be in.”
Noudga then stunned the court: “I was arrested for what? Something stupid that [Dellen Millard and Mark Smich] did?”
Friday, May 6 will mark the three-year anniversary of the murder of Tim Bosma.
