Tim Horton’s founder Ron Joyce is appealing a court decision allowing a 7.5-million-dollar sexual-assault lawsuit against him to go to trial.
The lawyer for the billionaire says the judge applied the wrong test as to whether Joyce and his accuser had struck an out-of-court deal.
The woman, who had a previous relationship with Joyce, claims sexually assaulted her at his Burlington home in May of 2011.
Joyce calls the woman a “pathological extortionist” and says he already paid the woman 50-thousand dollars as an amicable settlement over the alleged assault.
