“The plan was to steal, to kill, to incinerate. It was executed with chilling perfection and it was a long time in the making.”
Crown attorney Craig Fraser came out swinging at Mark Smich, now on his sixth day of cross examination at the Tim Bosma murder trial.
Fraser says the plan to steal a 3500 pickup truck was in the making as far back as February 2012.
“It’s a fact,” Fraser thundered, “Tim Bosma was to be shot and killed, his remains incinerated. The only two people to have anything to do with it were you and Dellen Millard.”
“Yes sir,” Smich agreed.
Fraser pointed out for a person who didn’t want to be involved “he was heavily involved with a plan and coverup of a murder where he was willing to destroy and move key evidence.”
Fraser said “This was a whole lot more than stealing a truck. Stealing was easy for you. You needed a target to kill. You needed a target to incinerate and that’s why it took over a year.”
“There wasn’t supposed to be anything to conceal,” said Smich.
Fraser pointed out in the Hamilton courtroom that “When it came to lunatic Dell, Smich showed no fear, no panic. Instead he’d spend 9 to 10 hours with his friend right up until his arrest, including the 2-and-a-half hours it took to clean out the dusted particles and bones of Tim Bosma from The Eliminator once it cooled.”
Smich was grilled all last week by the Millard’s lawyer.
Nadir Sachak ended his cross examination of the 28-year-old Oakville native today, claiming that according to Smich, all the key witnesses in the murder trial have lied.
Smich has testified the pair planned to steal a truck for the better part of a year and has told court Millard fatally shot Bosma during the May 6, 2013, test drive and burned his body.
Millard’s lawyer has argued that Smich is lying on the stand and that he actually shot the Ancaster father in a struggle inside Bosma’s truck.
Smich has said he buried the gun he believes was used to kill Bosma in a forest somewhere in Oakville, but cannot remember its location.
Both men have pleaded not guilty to first degree murder.
