A class-action lawsuit will proceed on behalf of a group of Caledonia residents and businesses.
A Superior Court judge has approved the suit which relates to the 2006 native occupation of the former Douglas Creek Estates development site.
Businesses and residents will seek to prove that Ontario Provincial Police and the province broke laws when they failed to enforce court injunctions and allowed for the closure of portions of Highway Six and Argyle Street four years ago.
The allegations must still be proven in court. Hamilton lawyers John Findlay says the plaintiffs have been broken down into several groups, including residents living nearest the D-C-E, businesses on Highway Six, businesses on Argyle Street and contractors.
The case will further inflate the cost to taxpayers of the land dispute. It already tops 64 million dollars, not including what the province paid for the Douglas Creek Estates or the adjacent home of a couple that recently settled out-of-court ending their lawsuit against the province.
