Arbitrator Rules Against Hamilton Health Sciences
    Canadian Press
    10/26/2009

An arbitrator has ruled that a registered nurse is entitled to damages from Hamilton Health Sciences.

The ruling case involves the case of a registered nurse who tried to return to work following an illness in the fall of 2005.

The Ontario Nurses Association adds that grievances were filed after HHS refused her return for more than half a year, even though she'd been cleared to resume normal duties by her family physician.  The arbitrator says that caused "unnecessary suffering".

Damages will be determined at a later date by the arbitrator, if not first to agreed to between the parties.

Ontario Nurses Association President Linda Haslam-Stroud calls it "ironic" that HHS is being held accountable for contributing to suffering and distress, after recently being named a top 100 Canadian employer by MacLean's magazine.
